Lawyer: Ararat cement decision confirms political nature of Tsarukyan case

YEREVAN, July 16. /ARKA/. The Anti-Corruption Court's decision to appoint a manager at Araratcement confirms that the law enforcement system is acting on the political instructions of the authorities, according to Yerem Sargsyan, lawyer for Prosperous Armenia Party leader Gagik Tsarukyan.

On July 16, the Anti-Corruption Court of Armenia granted the Prosecutor General's Office's motion to transfer the management and custody of Araratcement CJSC shares to the Republic of Armenia.

"Armenia faces an extremely serious legal security problem, as political authorities publicly announce upcoming criminal and other proceedings against specific individuals, after which the law enforcement system begins to implement these announcements. "In Gagik Tsarukyan's case, intentions to initiate criminal proceedings, arrest him, hold him in a penal institution, and confiscate his property were announced in advance. And the entire law enforcement system carries out these political instructions daily," Sargsyan wrote on social media.

He claims that the courts, which are considered independent, are also involved in this process.

The lawyer noted that if the relevant procedural actions were truly dictated solely by legal requirements, they would not have coincided with public statements by government officials.

According to Sargsyan, after earlier statements that Tsarukyan would not be allowed to leave the country, the Prosecutor General's Office charged him and obtained a travel ban. Then, the lawyer claims, the prosecution itself acknowledged the initial charges as unfounded.

He also recalled that after publicly declaring the need for Tsarukyan's arrest, he was detained and placed in custody.

"It was announced that Ararat Cement should be nationalized and a manager appointed. It was announced today that the Anti-Corruption Court, at the request of the Prosecutor General's Office, has made the corresponding decision," the lawyer said.

However, according to him, Tsarukyan's legal team was not notified of the review of the matter or of the decision, and the court decision itself has not yet been provided to them.

"All this clearly demonstrates that prior to the public statements by political officials, there was no need for such proceedings. After these statements, the entire law enforcement system suddenly began to act, explaining the events solely on legal grounds," Sargsyan stated.

He added that in the current situation, "talking about the rule of law and the rule of law is no longer necessary."
