Armenian government creates imitation of implementing Stockholm arbitration award – former acting CEO of ENA
YEREVAN, August 27. /ARКА/. The Armenian government is creating a facade of executing the Stockholm arbitration award, stated David Ghazinyan, the former acting CEO of Electrical Networks of Armenia (ENA).
At a press conference held on Wednesday, he mentioned that Narek Karapetyan, the Chairman of the Board of Directors of ENA, reached out to Mesrop Mesropyan, the head of the Public Services Regulatory Commission (PSRC) of Armenia, concerning the execution of the interim award from the Stockholm arbitration.
Initially, Mesropyan indicated that this matter was outside his jurisdiction; however, it was later revealed that he had sent a letter to the head of the government staff, seeking guidance on the recognition or execution of the Stockholm arbitration award.
He noted that the response from the relevant department within the government staff suggests that arbitration awards are generally required to be executed promptly and mandatorily by the involved parties, meaning that the authority to appoint a new manager should be halted by new legislative measures.
"We harbor reasonable doubts that the government is merely creating an illusion: they claim to be implementing it, presenting their viewpoint, while the commission (PSRC - ed.) is an independent entity that must arrive at its own decision," Ghazinyan remarked.
He stressed that this particular work style is not governed by the state, as the involvement of a state in an international treaty indicates that the Constitutional Court evaluates the document's adherence to the Constitution. Following this assessment, the treaty is forwarded to parliament for ratification, establishing that international treaties take precedence over domestic legislative measures.
Ghazinyan remarked that, ultimately, the responsibility now lies with the head of the PSRC.
"The Chairman of the Commission, upon receiving all pertinent information, informs the head of the Board of Directors of the ENA that this matter falls outside his jurisdiction, and the commission head acts in accordance with legal statutes. This raises the question of why he sought clarification from the government," he stated.
The former acting CEO of ENA contends that the head of the Public Services Regulatory Commission sought this clarification to determine the appropriate course of action.
On July 22, the Defense Council for Samvel Karapetyan, entrepreneur and owner of Electric Networks of Armenia CJSC, informed that Karapetyan and his family won the emergency arbitration proceedings against the Government of the Republic of Armenia in the case of the nationalization of Electric Networks of Armenia. It is noted that the court prohibited the RA government from confiscating or selling the assets of ENA, changing the composition of ENA's management bodies, revoking ENA's licenses and in any way restricting the company's natural business activities.
In response, the Armenian government stated that the appointment of a temporary manager of ENA does not contradict the decision of the Stockholm Arbitration Court and is aimed at preventing crises and identifying violations in the company's operations.-0-
